These Terms of Service ("Terms") govern your use of the Orator speech analysis platform ("Service") operated by Feynman AI ("we", "our", or "us") and accessible at orator.feynman.ai.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
Orator is an AI-powered speech analysis platform that provides:
- Speech transcription and analysis services
- Feedback on the "5 Ps" of effective communication (Pitch, Pause, Pace, Power, Prose)
- Practice tools and speaking exercises
- Historical tracking of speech analysis results (for registered users)
- Educational content and resources about public speaking
The Service is currently in beta testing phase and may include experimental features subject to change.
Account Creation
You may use our Service without creating an account for basic analysis features. To access additional features such as history tracking, you may create an account by providing accurate and complete information.
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
Account Eligibility
You must be at least 13 years old to create an account. Users under 18 should have parental consent before using the Service.
You agree not to use the Service to:
- Upload, transmit, or share content that is illegal, harmful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Upload audio containing private conversations without consent from all parties
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use automated tools (bots, scrapers) to access the Service without permission
- Interfere with or disrupt the Service or servers connected to the Service
- Use the Service for any commercial purpose without our written consent
- Upload malicious code, viruses, or other harmful software
- Impersonate another person or misrepresent your affiliation with any person or organization
Your Content
You retain ownership of any audio recordings and content you upload to our Service. By uploading content, you grant us:
- A temporary license to process your audio for analysis purposes
- The right to use anonymized, aggregated data for Service improvement
- Permission to store analysis results if you have an account
Data Processing
Your audio recordings are processed temporarily and then automatically deleted. We do not permanently store your audio files. Analysis results (transcripts, metrics) may be retained for account holders as described in our Privacy Policy.
Content Standards
You warrant that any content you upload:
- Does not violate any applicable laws or regulations
- Does not infringe upon third-party rights
- You have the right to upload and grant us the necessary licenses
- Does not contain private conversations without proper consent
Our Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of Feynman AI and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.
Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
Feedback
Any feedback, comments, or suggestions you provide regarding the Service may be used by us without restriction or compensation to you.
Our Service may contain links to third-party websites or services that are not owned or controlled by Feynman AI. We integrate with several third-party services:
- OpenAI and Deepgram for speech processing
- Supabase for authentication
- Google OAuth for authentication
- Vercel and Hetzner for hosting and infrastructure
We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of such third-party services.
Beta Status
Our Service is currently in beta. Features may be added, modified, or removed without notice. We strive to provide reliable service but cannot guarantee uninterrupted availability.
Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Maintenance
We may perform scheduled maintenance that temporarily interrupts service. We will attempt to provide reasonable notice when possible.

AI Analysis Disclaimer
Our speech analysis is provided for educational and improvement purposes only. Results should not be considered definitive assessments of speaking ability. AI analysis may contain errors or inaccuracies. Professional speech coaching should be sought for serious speech concerns.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FEYNMAN AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
Maximum Liability
Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid to us in the twelve months preceding the claim, if any.
You agree to defend, indemnify, and hold harmless Feynman AI, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

- Your use of the Service
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
Termination by You
You may stop using our Service at any time. If you have an account, you may delete it through your account settings, which will remove your personal data as described in our Privacy Policy.
Termination by Us
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Effect of Termination

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service.
Severability
If any provision of these Terms is held to be unenforceable, such provision will be struck and the remaining provisions will remain in effect.
Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment
